Maintenance indexation in The Netherlands for 2026

The Dutch government has announced that all maintenance obligations will be indexed by 4.6 % as of the 1st of January 2026.

Child maintenance and partner/ spousal maintenance are automatically indexed by law on a yearly basis in The Netherlands. The indexation is applicable to court orders as well as maintenance agreements. The automatic indexation can only be waived by either a written agreement between parties or a (new) court order.

Make sure you pay the correct maintenance

Maintenance and child support is indexed even if your original agreement does not contain any indexation clause. The raise is enforced by law and if you have not applied any indexation before, back payment can be demanded for up to five years previously.

Previous percentages

The percentages for previous years:

  • 2022: 1.9 %
  • 2023: 3.4 %
  • 2024: 6.2 %
  • 2025: 6.5 %

Though the rise is lower than the previous two years, the rise of nearly 5 % is still significant.

What if your income has not increased?

If your income has not risen with inflation or you have suffered a decrease in income, there may be grounds for adjustment of your maintenance. Our team would be happy to review your current financial situation and advise you as to your possibilities.
